1. Introduction

MyBerri Retail Solutions Private Limited is the licensed owner of the brand MyBerri™, including the MyBerri website ( and the MyBerri Mobile Applications (MyBerri for iOS & MyBerri for Android). MyBerri recognises the importance of maintaining your privacy. We value your privacy and appreciate your trust in us. This Policy describes how we treat user information we collect on MyBerri and other offline sources. This Privacy Policy applies to current and former visitors to our website, mobile applications and to our online Customers. By visiting and/or using our Platform, you agree to this Privacy Policy.

2. Agreement As a visitor or Customer to this Platform, you are advised to read the Privacy Policy carefully. By accessing the products & services provided by the Platform you agree to the Privacy Policy agreement. This Privacy Policy provides succinctly the manner your data is collected and used by MyBerri on the Platform.

3. Reference

The following terminology applies to these Terms of Use and all Agreements: "Client", "Customer", "You" and "Your" refers to you, the person using MyBerri Platform and compliant to the Company’s Terms of Use. "The Company", "MyBerri”, “Ourselves", "We", "Our" and "Us", refers to our Company. "Party", "Parties", or "Us", refers to both the Customer and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Customer in the most appropriate manner for the express purpose of meeting the Customer’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing law of India. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to the same.

4. Overview

As part of the registration process on the Platform, MyBerri may collect the following personally identifiable information about you: Name including first and last name, email address, mobile phone number and contact details, Postal code, Demographic profile (like your age, gender, occupation, education, address etc.) and information about the pages on the Platform you visit/access, the links you click on the Platform, the number of times you access the page and any such browsing information.

5. Eligibility

Services of the Platform would be available in Bengaluru, Karnataka, India. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 including un-discharged insolvents etc. are not eligible to use the Platform. If you are a minor i.e. under the age of 18 years you may use the Platform only under the supervision of a parent or legal guardian who agrees to be bound by these Terms of Use. If your age is below 18 years your parents or legal guardians can transact on behalf of you if they are registered users. You are prohibited from purchasing any material which is for adult consumption and the sale of which to minors is prohibited.

6. Information we collect
  1. Contact information: We might collect your name, email, mobile number, phone number, street, city, state, pin code, country, and IP address.
  2. Payment and billing information: We might collect your billing name, billing address and payment method when you buy or sell on MyBerri. We NEVER collect your credit card number or credit card expiry date or other details pertaining to your credit card on MyBerri. Credit card information will be obtained and processed by our online payment partner HDFC.
  3. Product or Services you buy : We collect the information you post on MyBerri for purchase or sale of products and services.
  4. Information you post : We collect the information you post in a public space on MyBerri, or on a third-party social media site connected or belonging to MyBerri.
  5. Demographic information: We may collect demographic information about you, events you like, events you intend to participate in, purchase and sale of products and services you buy or sell using MyBerri, or any other information provided by you during the use of MyBerri. We might collect this as a part of a survey also.
  6. Other information: If you use MyBerri, we may collect information about your IP address and the browser you are using. We might look at what site you came from, duration of time spent on MyBerri, pages accessed or what site you visit when you leave us. We might also collect the type of mobile device you are using, or the version of the operating system your computer or device is running and process this information to improve Customer experience on our Platform.
  7. Information you post : We collect the information you post in a public space on MyBerri, or on a third-party social media site connected or belonging to MyBerri.
7. We collect information in different ways
  1. We collect information directly from you: We collect information directly from you when you purchase or sell products and services on MyBerri. We also collect information if you post a comment on MyBerri or ask us a question through phone or email.
  2. We collect information from you passively: We use tracking tools like Google Analytics, Google Webmaster, browser cookies, and web beacons for collecting information about your usage of MyBerri.
  3. We get information about you from third parties: For example, if you use an integrated social media feature on our websites or application. The third-party social media site will give us certain information about you. This could include your name and email address.
8. Use of your personal information
  1. We use the information to contact you: We might use the information you provide to contact you for confirmation of a purchase on MyBerri or for other promotional purposes.
  2. We use the information to respond to your requests or questions: We might use your information to confirm your registration or purchase and sale of products and services.

  4. We use the information to look at site trends and Customer interests: We may use your information to improve MyBerri products & services better. We may combine the information we get from you with information about you we get from third parties.

  6. We use the information for marketing purposes: We might send you information about special promotions or offers. We might also tell you about new features or products. These might be our own offers or products, or third-party offers or products we think you might find interesting. Or, for example, if you buy or sell items using MyBerri we will enrol you in our newsletter.
  7. We use the information to send you transactional communications: We might send you emails or SMS about your account or purchase and sale of products and services.
  8. We use information as otherwise permitted by law.
9. Sharing of information with third parties
  1. We will share information with third parties who perform services on our behalf: We share information with vendors who help us manage our online registration process or payment processors or transactional message processors. Some vendors may be located outside of India.
  2. We will share information with vendors or suppliers: We share your information with vendors, suppliers, and other parties responsible for fulfilling the purchase or sale obligation. The vendors, suppliers, and other parties may use the information we give them as described in their privacy policies.
  3. We will share information with our business partners: This includes a third party who provide or sponsor a purchase or sale, or who operates a venue where we hold sales. Our partners use the information we give them as described in their privacy policies.

10. Choices available to you

To protect against the loss, misuse, or alteration of the information under its control, MyBerri has in place appropriate physical, electronic, and managerial procedures. For example, MyBerri servers are accessible only to authorized personnel, and your information is shared with employees and authorized personnel on a need to know basis to complete the transaction and to provide the services requested by you. Although MyBerri will endeavour to safeguard the confidentiality of your personally identifiable information, transmissions made by means of the Internet cannot be made secure. By using MyBerri, you agree that MyBerri will have no liability for disclosure of your information due to errors in transmission or unauthorized acts of third parties.

A. Email Opt-Out
You can opt-out of receiving our marketing emails: To stop receiving our promotional emails, by sending an email to [email protected] . It may take about ten days to process your request. Even if you opt-out of getting marketing messages, we will still be sending you transactional messages through email and SMS about your purchases and sales.

11. Third-party sites

If you click on one of the links to third party websites, you may be taken to websites we do not control. This policy does not apply to the privacy practices of those websites. Read the privacy policy and Terms of Use of other websites carefully. We do not control or are not responsible for these third-party sites.

12. Modification of the Privacy Policy

MyBerri may at any time modify the Privacy Policy of the Platform without any prior notification to you. You can access the latest version of the Privacy Policy at any given time on the Platform. You should regularly review the Privacy Policy on the Platform. In the event the modified the Privacy Policy is not acceptable to you, you should discontinue using the Service. However, if you continue to use the Service you shall be deemed to have agreed to accept and abide by the modified Privacy Policy of our Platform.

The headings of the paragraphs of this Agreement are inserted solely for the convenience of reference. They will in no way define, limit, extend, or aid in the construction of the scope, extent, or intent of this Agreement.

No provision of this Agreement may be amended or waived unless agreed and issued by MyBerri.

This Privacy Policy agreement and any exhibits if attached to it contain the entire understanding between the parties and supersede all prior agreements and understandings relating to the subject matter of the Agreement.

13. Governing Law & Dispute Resolution

MyBerri agrees to cooperate fully and to provide support in resolution of any complaints, claims, actions, or proceedings that may be brought by or that may involve the Customer.

Any dispute that may arise regarding this agreement shall be resolved, by mutual discussion and understanding. If the issue has not been resolved, the same shall be referred to arbitration. Any legal notice or other communication will be deemed to be properly given only when sent via the Indian Postal Service or a nationally recognized courier, addressed as shown in the last page of this Agreement.

The Privacy Policy is governed by the laws of India. Any action, suit, or other legal proceeding, which is commenced to resolve any matter arising under or relating to this Platform, shall be subject to the jurisdiction of the courts at Bengaluru, Karnataka, India.
